TERMS AND CONDITIONS

Definitions:

‘You’

Any person holding a valid ticket to attend the event.

By purchasing or holding a ticket to this event you agree to be bound by the following Terms and Conditions. The Promoter reserves the right to revise these terms and conditions at any time.

These Terms and Conditions are to be read together with all other statements or directives either shown on any tickets or displayed on Our website or at the event and side street show venues.

The term “including” when used in these Terms and Conditions is not a term of limitation.

We reserve the right to vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after any such variation.

We reserve the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.

You agree to enter the event site at your own risk. You are primarily responsible for your own behaviour and personal conduct for the entire duration of the event, including the entrance into the event and exit from the event. It is your responsibility to wear appropriate clothes and shoes suitable for walking short distances, standing for long periods of time, and changing weather conditions. Responsible consumption and service of alcohol will be strictly adhered to by all present at the event site. Site managers, security guards, an RSA officer, and event crew members will be present for the duration of the event to ensure patrons’ safety to the best of their ability.

Entry to and exit from the main event site is strictly via the entry gates only – located along Sportsmans Parade, Bokarina. Any attempts to access the site at any other point or via any other route or means will be considered trespassing and police will be called.

Buskers by the Lake is an all weather event and no refunds or exchanges on any ticket will be granted except as required by and/or specified by the Live Performance Australia Industry Code of Practice. Incorrect purchases are NOT eligible for a refund.

No food or drink may be brought into the event and/or side street show venues including alcohol or drugs of any type (unless medically required).

Smoking is permitted in designated areas only.

No glassware or other sharp objects may be bought into the event or side street show venues.

No animals may be brought into the event, unless they are performing or classified as a support.

You may be denied entry into, or removed from, the Premises if:

You breach the Terms and Conditions;

You are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the events by others

You may be required to submit to a search of your person and/or possessions before entering the event.

Entry to an event may be refused if the authenticity or validity of a ticket is in Our opinion questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Buskers by the Lake or other authorised points of sale.

Where concessions are applicable, suitable and valid identification must be provided for collection of tickets and at the event.

Tickets may not, without Our prior written consent, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder may be refused admission. We will take all reasonable steps to notify You of Our intention to cancel the ticket or render it invalid within a reasonable time before cancelling it or rendering it invalid.

When purchasing tickets for a particular event You may be limited to a specified number of tickets. If You exceed the stated ticket limit, You may have any or all of your orders and tickets cancelled without notice by Us at our discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for fans, and as a measure to minimise ticket scalping.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

Vehicles are parked at your own risk. We will not be responsible for loss of, or damage to any vehicle, accessory or contents in, or on any vehicle.

Minors under the age of 18 must not enter licensed areas without being accompanied and supervised by a parent or legal guardian 25 years of age or older.

You are responsible for all persons under Your supervision and must ensure that any persons under Your supervision comply with these Terms and Conditions .

You are responsible for your own personal property. We will not be liable for any person in respect of loss of life or personal injury to, any person, whether that loss, damage or personal injury is caused by any person’s negligence (including the negligence of Us) or otherwise.

You must obey all reasonable instructions and warnings, given by Us and Our staff and contractors, without objection.

We do not offer a refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond Our control.

We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances. We reserve the right to charge you a reasonable fee for the replacement of tickets. Please treat your tickets like cash, as we cannot replace lost tickets.

We reserve the right to alter the entertainment and activities as advertised, without prior notice to You. Your entitlement to a refund in such circumstances is determined by Buskers by the Creek Inc.

If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.

You must apply for a refund within a reasonable time. We do not offer refunds or exchanges as a result of a change in your personal circumstances. If we authorise a Refund, We will refund to you the ticket price.

Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.

We fulfil Our commitment to you for the sale of tickets by emailing the ticket to you. If you have not received your ticket(s) within 48 hours of the event, please contact Us.

If an event is cancelled or rescheduled Our liability is limited to the amount for which the ticket was purchased. Proof of purchase may be required for any refund or exchange. We will not be liable for any other losses incurred by You as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

We do not replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket cannot be verified, including proof of purchase, and only if You give reasonable notice before the event. We may charge a reasonable fee for the replacement of tickets. We are not required to replace tickets where seating is unallocated (general admission tickets).

The Buskers by the Creek Inc. Privacy Policy is incorporated into these Terms and Conditions and apply to all sales through this Site.
